Terms of Service for Niche

1. Acceptance of Terms

By accessing and using this website, you accept and agree to be bound by the terms and provision of this agreement. In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services. Any participation in this service will constitute acceptance of this agreement.

2. Description of Service

Niche provides custom packaging design and manufacturing services. Our services include, but are not limited to, brand development, artwork preparation, 3D proofing, and production of custom packaging materials. All services are provided "as is" and the company assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings.

3. Quotes and Orders

All quotes provided by Niche are valid for 30 days from the date of issue. Prices are subject to change based on material costs and other factors. An order is considered confirmed once a deposit has been paid or a formal purchase order has been received. By confirming an order, you agree to the specifications and costs outlined in the final proposal.

4. Artwork and Proofing

Customers are responsible for providing print-ready artwork according to our specifications. While we offer artwork preparation services, the final approval of all designs and proofs lies with the customer. We are not responsible for errors in the final product caused by mistakes in the approved proof, such as typos, grammatical errors, or incorrect color codes.

5. Payment Terms

Payment terms will be specified in the proposal. Typically, a deposit is required to commence production, with the balance due prior to shipping. We reserve the right to hold shipment of goods until full payment has been received and cleared.

6. Limitation of Liability

Niche's liability for any claim arising out of the performance or non-performance of our obligations shall be limited to the amount paid by the customer for the services. In no event shall we be liable for any consequential, indirect, incidental, special, or punitive damages.

7. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising under or in connection with this agreement shall be subject to the exclusive jurisdiction of the English courts.

8. Changes to Terms

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms.
