These Terms of Service ("Terms") govern your use of the website operated by Niche Brands Ltd ("Niche", "we", "us", or "our"), a company registered in England and Wales (company number 16702466), with registered address at 66 Paul Street, London, EC2A 4NA. By using our website or requesting a quote, you agree to these Terms.

1. About our website and services

Our website provides information about our custom hospitality packaging and allows you to browse products, build a list of items, and submit an enquiry or quote request. The website is not an online shop. Submitting a quote request or enquiry does not create a binding order or contract — it is a request for us to provide a quotation. A contract is only formed once we have provided a written quote and you have confirmed acceptance, and we have acknowledged your order.

2. Quotes and pricing

Any prices shown on the website (including "from" prices) are indicative guides only and do not constitute a binding offer.
Formal quotes we provide are valid for the period stated in the quote, or 30 days where no period is stated.
Quotes are based on the specification, quantities, and artwork requirements discussed. Changes to any of these may change the price.
Unless stated otherwise, prices exclude VAT and delivery, which will be set out in your quote.

3. Minimum order quantities and lead times

Our products are subject to minimum order quantities (MOQs), which we will confirm in your quote. Any lead times or delivery dates we provide are good-faith estimates, not guarantees. Lead times typically begin once artwork has been approved and payment terms agreed. We are not liable for delays caused by factors outside our reasonable control, including supplier or courier delays.

4. Artwork and approval

Because our packaging is custom-printed, artwork approval is an important step:

You are responsible for ensuring that any artwork, text, logos, or designs you supply are accurate, lawful, and that you have the right to use them.
We will provide a digital proof for your approval before production. Once you approve a proof, you accept responsibility for its content, including spelling, colours (as far as can be represented digitally), layout, and specification.
We cannot be held responsible for errors in artwork you have approved, and reprints to correct such errors will be chargeable.
Printed colours may vary slightly from on-screen proofs and between production runs; this is inherent to the print process and is not a defect.

5. Bespoke goods and cancellations

Our products are made to your specification and are therefore bespoke. As such, once production has begun, orders cannot be cancelled or returned except where the goods are faulty or not as agreed. This does not affect your statutory rights in respect of faulty goods. If you are a consumer, please note that the right to cancel under the Consumer Contracts Regulations does not generally apply to goods made to your specification.

6. Payment

Payment terms will be set out in your quote or order confirmation. We may require full or partial payment in advance, particularly for first orders or bespoke production. Goods may remain our property until payment is received in full.

7. Delivery and risk

We will agree delivery arrangements with you as part of your order. Risk in the goods passes to you on delivery. Please inspect goods promptly and notify us of any damage, shortage, or defect within a reasonable time so we can put things right.

8. Intellectual property

All content on this website — including text, graphics, logos, and design — is owned by or licensed to Niche Brands Ltd and may not be copied or reused without our permission. Any artwork or brand assets you supply to us remain yours; you grant us a licence to use them solely to fulfil your order.

9. Our liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be excluded. Subject to that, we will not be liable for any indirect or consequential loss, loss of profit, or loss of business, and our total liability in respect of any order will not exceed the price paid for that order. We provide the website "as is" and do not guarantee it will be uninterrupted or error-free.

10. Privacy

We handle your personal data in accordance with our Privacy Policy, which forms part of these Terms.

11. Changes to these Terms

We may update these Terms from time to time. The version published on this page at the time you submit an enquiry or order is the version that applies.

12. Governing law

These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
